We never rush a settlement — we wait until you’ve reached maximum medical improvement to ensure you receive full compensation.
You can still recover compensation. New York follows a “pure comparative negligence” rule — your award is reduced by your percentage of fault, but you’re never barred from recovering. If you were 20% at fault and damages are $100,000, you could still receive $80,000.
